Facts
At a dinner at a senior IAS officer's residence in Chandigarh, attended by senior officials, advocates and journalists, the accused — a senior police officer — slapped a woman IAS officer (Mrs Rupan Deol Bajaj) on the posterior in the presence of the assembled guests. She raised an immediate hue and cry. He was prosecuted under IPC ss. 354 and 509.
Issue
Whether the act amounted to outraging the woman's modesty under s. 354 — and whether the setting (a social dinner, a senior complainant) or the accused's intention displaced the offence.
Held
Conviction upheld. The Court held the act plainly outraged the complainant's modesty: "gently slapping on the posterior of the prosecutrix in the presence of other guests would embarrass her," and knowledge could be attributed to the accused that touching her body at that place and time would outrage her modesty. That she was a senior officer and the setting was social changed nothing — "had it been without any culpable intention … nobody would have taken notice"; her immediate protest confirmed the outrage.
Ratio
Modesty is an attribute of the woman herself, independent of her rank, age or the social setting; the test of s. 354 is whether the act was one that the accused knew or intended would outrage that modesty. A physical act of this kind, done in public, carries the knowledge on its face. The offence is not diluted by the complainant's seniority or by the informality of the occasion.
Under the BNS
The offence is now s. 74 (assault or use of criminal force to a woman intending or knowing it likely to outrage her modesty — one to five years), with s. 79 for words, gestures or acts intended to insult modesty. Gill remains the working authority on what "modesty" means. Place it in the Unit 6 short note on the ss. 74–79 graded set (outraging modesty, sexual harassment, disrobing, voyeurism, stalking).
